Subcontract Bonding Tip: Pay When Paid

Here is a subtle but important point for insurance professionals who have General Contractor clients or Subcontractors.

We know that the days of the handshake contract are mostly over. In today's highly litigious society, businesses are naive if they do not rely on the services of their attorneys in legal matters and utilize written contractual documents on all their projects.

General Contractors (GC's) have an advantage when entering into contracts with the trade Subcontractors they hire (such as electrical firms, plumbers and HVAC subcontractors). The GC is giving out the work and has an opportunity to control the contract language. For subcontractors, it's harder. They may face a "take it or leave it" scenario with the GC on the contract language.

In a construction contract, a "Pay When Paid" clause is intended to control the GCs obligation to pay the sub. The idea is that, despite any stated payment terms to the subcontractor (such as payment every 30 days), the GC is not expected to pay the sub until the project owner pays them. The assumption is that such contract language means:

"When I get paid, YOU get paid!"

Enter the better alternative: "Pay IF Paid." The difference is important.

Pay When Paid establishes that the GC is obligated to pay, and the timing is governed by receipt of funds from the project owner. Pay If Paid means the GC is NOT obligated to pay the sub UNLESS they receive payment from the project owner - a huge difference.

Here is an example of Pay If Paid wording *:

"It is expressly agreed that owner's acceptance of subcontractor's work and payment to the contractor (GC) for the subcontractor's work are conditions precedent to the subcontractor's right to payments by the contractor (GC)."

The Range of Star Wars Merchandise

Star Wars is widely regarded as one of the best science fiction sagas ever told. The legions of fans it has attracted, and the amount of money it has earned reinforces this claim. But it isn't just about movies and films. It has branched off into many other subcategories and genres that you wouldn't expect a science fiction franchise to do.

Let's start from the ground up and take a look at the products for younger kids. You have bed sheets, curtains, dressers, pencils, learning games, back packs, duffel bags, clothing, and pretty much anything else that you could want for school or home. As far as toys are concerned you have action figures of various complexities for different age ranges. You also have model vehicles and play sets to keep your children entertained on the subject.

The Star Wars toys have been in production for some time and the ones that our children play with today are not the ones we grew up with. The ones we had were typically die cast metal figurines that were meant to be posed and the battles imagined, rather then acted out with flexible figures. In addition to the metal figurines you could find metal and plastic models of ships and vehicles. There is currently a debate on amongst collectors about which toys are better; currently there is no end in sight for this debate.

After you move out of the toy related products you can then move onto the more home related ones. Star Wars costumes always show up at Halloween, and there are plenty of posters to go around. Now we come to perhaps the most stimulating of the available merchandise. This would be books, and Star Wars has several hundred of them. Not all of them are set in the same era as the films and many of them have been New York Times Best Sellers.

These range from large hardcover novels to small comic books, needless to say they all bring color and a different perspective to one of our favorite universes. Finally we come to the video game and movie section. Star Wars video games have been around for a very long time, and have advanced with technology. In the early days of gaming it was hard to make a good game based on this franchise simply because of the technological limitations of the time.

As we progressed over the years Star Wars games started to move from the arcade, into the living room. They now are in almost every home and range across all the consoles regardless of age. PS1, PS2, PS3, GameCube, Wii, Game Boy, PSP, Xbox, Xbox 360, and the PC all have numerous Star Wars games on them and make for an entertaining diversion at any time. Of course these wouldn't be complete without films to augment and accompany.

The Evolution of Nokia's Smartphones and a Preview of the New Nokia N97

Nokia, while having 38% store global store share, has never truly been a proximity in the world's two largest economies, America and Japan. We can calculate as to why this is, but the main reasons behind it are lack of hold from providers, and products that weren't exactly what consumers in these markets were finding for at distinct points in time.

Certainly, Nokia is an innovator in the industry, their Series 40 operating ideas was regarded by many Europeans and Asians as the benchmark. However, what happened after that? Why were other newcomers such as Samsung and Sony Ericsson able to gain so much, so fast? My idea is that Nokia stopped mental out of the box, and tried to apply the Kaizen (continuous improvement) philosophy to something that required constant innovation and reinvention instead. You see, cell phones are not excellent devices. There are devices we have that serve their purposes singularly well, almost to the point of perfection. Take a Japanese knife, for example. It has been engineered and refined over time, to a point where the balance is as excellent as possible, the blade is as sharp as potential and the aesthetics have reached their height as well. There isn't much more that we will likely do with such a knife. This evolutionary approach is fine for things like Japanese knives, but not for new technology that hasn't quite found a permanent footing.

We are just starting to witness what a personal handheld gadget can do for us, and in the last few years, what have we seen? The particular biggest leap was the iPhone. Not because of any features mind you, but because of the way we interact with the device. It, single-handedly, has changed how we will interact with devices forever. Microsoft has taken a page from the iPhone book, and has talked of the idea of a large pane of glass with multi-touch inputs. Apple has taken iPhone-style input and added it to the trackpads in their most recent laptops, and just about every constructor has, or in the near future, will come out with a phone with an extra large touch input on the front.




Forward mental create is what makes the iPhone so unique, and it continues to this day. Google for example, takes advantage of the Gps, proximity sensor, microphone and 3G association to offer a very usable hunt program that can find results catered to your surroundings faster than a similar text entry could be input. Has Nokia innovated in this fashion? Arguably, in the cell phone world, not many have, but expectations of the store leader are high.

Nokia took the right decision to go down the smartphone road way back with the 7650. That was a very innovative phone, even a miniature ahead of its time. Running an open operating system, integrated camera, sliding design, the 7650 could have stormed North America and Japan. It was for real capable of Mp3 and video playback, convention ringtunes, and a host of other features that are popular with today's phones. Nokia for real did not store the gadget as well as it should have, especially in the markets that matter the most.

From the 7650, Nokia moved to devices like the 6600 and 3650. What sort of progress did Nokia make with this step? Next to nothing. The 7650 had an operating system, Symbian, that allowed for applications to be installed. European and Asian developers started development all kinds of programs for the phone, from frontends to Office document viewers, to file explorers, Mp3 players, video players and much more. The phone was qualified with a camera, and the fairly open operating ideas allowed for a quite a lot of development.

The supposedly next-generation 6600 offered miniature in the way of improvement. A dissimilar form factor, candybar, rather than slider, but the same screen with the same resolution and size, no major differences to the Os and the exact same battery meant that it was an aesthetic makeover more than anything. The 6600 took off in popularity in the European and Asian markets, and in 2005, made its way to North America as well, where it didn't find the kind of success it did abroad. Another phone was released colse to the same time, the 3650, which was largely the same as the 6600, but was aimed at the youth markets with its funky styling.

After these came the 7610, which followed Nokia's now-common convention of aesthetic changes combined with a higher pricetag. It offered a marginally best 1-megapixel camera, but by now, the Symbian Os had third-party software upconversion of photos that interpolated 1 megapixel images out of the Vga camera in the 6600 and 3650. These interpolated images that looked almost the same as those from the true 1-megapixel 7610.

The "next-gen" 6630 was the first 3G smartphone from Nokia, and that, along with the stereo headphone production was all that was new. It didn't quite make full use of the 3G, because 2-way video calls were something that was considered part and parcel of 3G phones, and the 6630 didn't have a front-facing camera.

Nokia did, however, sell a dock with an integrated camera separately, so that 2-way calls could be made. The dock had to be plugged in though, so in operation, it wasn't much dissimilar from using a computer with a webcam, and wasn't very "mobile." Even though all of Nokia's smartphones were more than capable of Mp3 playback, none had stereo audio production (smart, Nokia), even though the iPod's popularity could clearly be seen at the time. Users were restricted to monaural audio playing back straight through the loudspeaker, straight through the wired monaural headset, or straight through a low-quality monaural Bluetooth headset. Yes, they all had Bluetooth, from the start! When we got to the 6680, Nokia added a slightly best camera in the back, and a front-facing Vga camera for 3G video calls, after studying their part with the 6630.

Curiously, there were no other changes. By now, Nokia's innovation had slowed to a standstill. In contrast, Apple released a product that didn't do that much more technically, but for real stood behind the software and continually pushed its amelioration with each firmware update, something that Nokia could have done, having the most first-rate hardware and software at the time.

At this point, Nokia decided it needed to rejuvenate its image straight through the marketing department, and then came the N-series phones. These were again, not fundamentally dissimilar from the preceding phones, but were marketed as being better, as being "multimedia computers." They started adding more features this time around, such as best cameras, Carl Zeiss lenses, optical zoom on a model or two, and finally Wi-Fi. Some models were just rehashes of existing models; check out the similarities in the middle of the 6680 and the N70.

With the N-series came a newer version of Symbian, one that would not run most of the existing applications. As consumers, we know the stigma of not having backwards compatibility (cough, Ms Vista, cough Ps3, cough), so the amelioration cycle began anew. What's thoughprovoking to note is that even though the Symbian platform got an update, it didn't look or feel any different. It never had the thoughprovoking menus and ease of use that Sony Ericsson's phones had, but with the fancy Os, there should have been more changes.

Applications have always been short of memory on the Symbian platform, and with the exorbitant prices that Nokia has always charged, more memory wouldn't have hurt. Even in its most recent iteration, the Symbian platform is not what you'd call smooth, relative to the iPhone Os or Blackberry Os. Apps don't co-operate the way they should. If you receive a Word document in your e-mail, it won't necessarily open up with the correct viewer, and in the rare event that it tries, crashes and slow speeds are a surity. Nokia came out with a good browser on the N80, and has used it since, but its welcome has worn off. It was great when it first came out, miles beyond everyone else's browser. Since then, apparently, miniature amelioration has been made. It's still a royal pain in the butt to surf, and even more so on flash-heavy sites. Flash of course, doesn't work fully. Dream if they made it work... It'd be the first phone capable of browsing the full internet, something even the iPhone struggles with. The N90 and N93 were for real interesting, but were plagued with the same issues. The N93 had a flip-open mode, just as this new N97 does, but it wouldn't always register the flip and go into scenery mode, or, would do it very slowly.

While the N95 has been Nokia's magnum opus for some time now, its software is eons behind iPhone and even Blackberry in its reliability. Crashes and slow boot times don't make for a good user experience, and consequently unhappy customers.

Another problem has been that the reality of the features hasn't lived up to the hype. Integrated Gps was a great idea in the N95, but Nokia didn't consist of any usable turn-by-turn navigation software, and instead, wanted to payment for it. Slow to lock on and often inaccurate, the Gps was largely a waste. The N95 featured a 5-megapixel camera with a Carl Zeiss lens, but took fairly mediocre pictures that were for real beat by a cheap handheld camera. The time needed to go from application start to picture taken was unbelievably long too. Meanwhile, Samsung's phones in Korea and the Japan-only phones had excellent cameras.

Smartphones need good screens. Plus, consumers love big screens. Sounds like a no-brainer... Have a good screen, right? Nokia went from using lowish resolution 2.23 screens to a brilliant 352×406 screen in the N90 and N80 that had pixels so tight, they couldn't be seen with the naked eye.

Granted, the screen size was small, but this effort was in the right direction. Unbelievably, after the N80, Nokia went right back to using low resolution screens, exclusively. Until now, they increased size, but not resolution. Given all that, I think you can see why Nokia hasn't fared all that well in North America and Japan. For all their flaws, each new phone cost the whole of a full blown laptop, something that doesn't conclude all that well with value-centric North Americans (we spend more than anyone else on the planet, but want to get our money's worth!).

And now we get to Nokia's new baby. The N97. Clearly, Nokia wants to play off the popularity of the N95 by following its alphanumeric pattern, but oddly, this seems to make light of the fact that the N96 was quite the dud. Essentially the exact same as the N95 (what is with that?) with 16 Gb vs. 8, we never for real saw it take off... It made the blogs, citizen reported buying them in Singapore and wherever, and now... Nokia has moved on. Anyways, good for them that they did, because the N97 is clearly the first big step since that first-rate 7650.

Nokia finally seems to have understood that finger-based touch input is here to stay, and has included one hell of a screen to quiet my complaining. 640 x 360 resolution, which makes it a 16:9 display, perfectly cordial with oh, contemporary Tv and movies, something that 20 and 30somethings would love. Incidentally, they are the ones who'd spend on such a device... Good Nokia, good! You're finally starting to understand your target market! They've gone a step ahead and included tactile feedback. This is more software than hardware, because the iPhone is technically capable of this too, but I'm thoughprovoking to see how well-implemented it is. There were mice with tactile feedback some time ago, where you'd roll the cursor over a link and you'd "feel" the link there. I'm not sure if that helps in any way, but hey, if Nokia found a way to make it useful... Awesome.

Also, Nokia apparently realizes that the internet is important, and so, a full tactile Qwerty keyboard flips out. This is a great feature, which will for real find favour here. It's thoughprovoking to see how much Nokia has borrowed from the iPhone in terms of style... It can be seen the most when the screen is off.

Hsdpa and WiFi radios were a must, and they're there, but hopefully the WiFi is N-grade this time colse to and has decent range. 32 Gb of onboard warehouse And a microSd slot shows they've been listening to what citizen want, and this highlight solidly trumps the iPhones unexpandable memory. They say the camera is 5 megapixel, Carl Zeiss lens, and can shoot Vga video at 30 fps. Well, so what? My 2.5-year old N93 could do that. In 2009, the phone should have been able to do at least 720p video with sound equivalent to the N93. I think this is the weakest part of the phone, frankly.

Finally, one of the most prominent pieces of the puzzle, the Os, gets a real upgrade. From the pictures, it looks like Nokia has taken its old ideas, and elevated them to a new level. The "today" screen, present on the last few generations, would present calendar appointments, to-do notes, e-mail and text messages on the main screen, letting you know what you need to at a glance. They've given it the glossy Apple rehabilitation this time around, and the today screen, thanks to the large resolution and size, now includes Facebook, Myspace, weather and a whole of other alerts. This too, in my opinion, trumps the iPhone in terms of real usability, because you can get tons of beneficial information at a glance, rather than having to go into personel applications. Clear big buttons (in the pictures) indicate that this version might be easier to use, something Symbian desperately needed. If the software is as good as it looks, and the touchscreen works as well or best than the iPhone's, it looks like we have a real winner on our hands. The pricing for this will be well into the 0s unlocked, but if North American carriers pick it up and offer it at a decent price, this phone could for real do well if Nokia markets it right. I'm finding send to testing it!

How often have you heard man start a speech with a joke? Too often probably. Speakers with minuscule touch tend to tell jokes just to get a laugh in the hope the audience will warm up to them. The jokes are often irrelevant to the topic of their speech.

Experienced speakers know there are good ways to add humor to a speech or presentation, including:.

I'd sometimes bring along "Ifb" to use as a as a prop. An Ifb (which stands for "interruptible feedback) is an ear piece Tv reporters use when they're doing live reports from the scene of a news story. The Ifb allows them to hear what the citizen back in the studio are saying to them as they're being introduced, and also allows them to hear questions the anchors might ask.

I would sometimes show a blooper clip of what can happen when something goes wrong with an Ifb. The clip showed a female reporter stuttering and stammering during a live report. She sounded truly smashed. She wasn't.

It turns out man had unintentionally pressed the wrong button back in the control room, and the reporter was hearing her own words in her Ifb about half a second after she spoke, which, take my word for it, is extremely distracting. For about 15 seconds, she battled and tried to be as expert as she could, but the harder she tried, the funnier she sounded. She ultimately ripped the Ifb from her ear and continued her report.

The clip always got the audience howling.

Borrowing humor

The Internet is a great place to find one liners and funny quotes. Personally, I borrowed often from Yogi Berra ("When you come to a fork in the road, take it..."), Will Rogers ("when Democrats want to form a firing squad, they get into a circle...") and many others.

How To Set Up Xbox 360 Live

So you have gone out and bought the Xbox 360!? It was a remarkable decision and you will enjoy hours upon hours of playing time with your new device, but before you get started into the wide world of online gaming you are going to need to know how to connect the 360 to the Live network.

If you have not set up an inventory you will be prompted to do so. All you need to do is follow the on screen instructions. It is a pretty cut and dry process and should not take more than 10 minutes of your time.

If you want to go wireless or you must go wireless you will need to get the Xbox360 wireless network adapter. The adapters are ready at most shop that sell 360 games or you can order it online. Once you have the adapter unplug any Ethernet cable you might have plugged into the 360 then clip the Network adapter to the back of the 360. It is really easy to see where it belongs, but just in case, the adapter will sit right alongside the Usb port which is right above the Ethernet port. Once you have clipped it in plug the Usb cable that is attached to the adapter into the port on the Xbox 360. Flip up the antenna that is laying flat against the adapter and you are set, well approximately set.

Turn on the 360 and head into the law tray. You will see Network options, go ahead into that screen and follow it straight through to the "Edit Settings" subcategory. I asked Majestic Modifications what their conception was on the subject. How do they setup so many units and all the time get it right?

First, if applicable, all the time use the harnesses. The aftermarket wiring harness will regularly take the guesswork out of the installation. These harnesses attach to the vehicle's premise wiring harness and gives you a color coded installation. You just attach red to red, yellow to yellow, etc. But is that all an installer should know?






Starting with your digital multimeter, find the power sources in the harness. One source will be continuous 12 volts, the other will be the Acc (ignition) 12 volts. These two will go with the yellow and red wires from the aftermarket head unit's harness. They are labeled accordingly. It is regularly a good idea to attach the ground wire to the frame of the dash. A lot of head units come with a connector for this already attached to the ground wire. fetch these in place with some solder and shrink tubing. Slip the shrink tubing over one of the wires to be linked and move it out of the way. Connect the wires and dab a small solder on the wires. Let cool and then slide the heat shrink tubing over the connection. Heat with a heat gun/hair dryer to shrink the tubing to fit.

The other way you can trace the speakers down is to turn on the head unit, but be Very truthful to not cross any wires. Start with a pair of wires, and attach them one at a time until you get sound. Note which speaker it is and attach it to that speaker's wires from the wiring harness, taking not of polarity. Continue until all the wires are in place. Zip tie the wire together and neatly tuck them behind the head unit.

Be sure you have a good ground wire connection. Be sure that Rcas or signal wires are running away from any power wires or sources, and are not run parallel to them.

If you want a neat trick, you can attach the 12 volt acc to the illumination wire, and you will be able to turn the unit on with your parking light switch. Take note, that anytime the unit is on, the dash panel lights will be on too, but you won't observation them in the daytime. The illumination wire is used to turn the premise radio lights on at night.

Not having the wiring harness for your car is not a do or die situation. If you can get the harnesses, save the hassle and time and use it. If you find yourself in a bind, then succeed the steps above and get it installed correctly.

The Xdh111 improved the situation immediately. The signal meter shot to it's highest for the first Hd title we streamed and to the top level of the acceptable def level on the non-Hd titles. The Hi-Def titles look astonishing over the Netflix streaming, but the acceptable def titles still seem just a tad soft even though the signal meter on the player is showing the best signal. I'm going to experiment by curious the location of the Netgear hub to a different location in my house on the same electrical circuit as the player - fortunately, I have some options here because I have hardwired Ethernet jacks at any locations in my home.

Stupidly, when I built the house 5 years ago, I never carefully needing an Ethernet jack behind my Tv. I mean, after all, game consoles would never offer online play and there's no theorize to have a Pc in my living room...Ugh, what an idiot I was.

As for Netflix, even though new releases are mostly not available for streaming, there is one huge piece of the Netflix instant queue that I immediately zeroed in on: Tv Box Sets galore. I guess I'm still of the plan that Netflix by mail is going to be a immense pain in the ass, but we'll right on be giving that a shot with newer releases.
